Intel claiming for compensations for infringement of copyrights
Last month, upon the applications of Intel for perpetuation of evidence,
Shenzhen Middle Court seized the products sample, software, user's manual,
relevant documents and financial statements of Donjin Technology. It is
reported that it is the biggest case involving the infringement of intellectual
property rights ever received by Shenzhen Middle Court.
The case can be traced back to last December, when Intel went to Shenzhen
Middle Court, accusing against Donjin Technology for infringement of its
intellectual property rights on computer software. As they accused, Donjin
Technology copied, issued and spread through the information network a
certain software of Intel without getting their consent, which is an obvious
infringement of the copyright of Intel. Intel claimed for a compensation
of 7.96 million USD for this. On Dec. 21 of 2004, Intel applied to the
court for perpetuation of evidences, requiring the court to seize the
above-mentioned materials of Donjin Technology.
According to Shenzhen Middle Court, the application of Intel is legal.
Thus, it seized and sequestrated the suspected materials, and will hold
hearings of this case on March 23 this year.
